1. Acceptance of Terms
By using this website, contacting Columbia Insulation for a service estimate, or engaging Columbia Insulation to perform insulation work, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website or engage our services.
These terms apply to all visitors, inquiries, and customers. We reserve the right to update these terms at any time. The version published on this page at the time of your engagement with us governs the relationship.
2. Description of Services
Columbia Insulation provides insulation contracting services, including but not limited to spray foam insulation, blown-in insulation, attic insulation, crawl space insulation, basement insulation, wall insulation, air sealing, vapor barrier installation, insulation removal, and related services for residential and commercial properties in Columbia, MO and surrounding areas.
All services are subject to a written scope of work agreed upon before installation begins. Services are performed only at properties for which the customer has the legal authority to authorize construction work.
3. Estimates and Pricing
Estimates provided by Columbia Insulation, whether in person, by phone, by email, or through this website, are good-faith assessments based on the information available at the time of the estimate. An estimate is not a binding contract. Final pricing is confirmed in a written proposal or agreement signed by both parties before work begins.
Actual costs may differ from an initial estimate if site conditions differ from what was observable during the estimate visit, if the scope of work changes at the customer's request, or if unforeseen conditions require additional materials or labor. Any changes to scope or price will be communicated to the customer and require written authorization before additional work proceeds.
All estimates are provided at no charge and carry no obligation to proceed.
4. Scheduling and Cancellation
Installation dates and times are agreed upon in writing or by phone confirmation at the time the job is scheduled. We will make reasonable efforts to arrive within the agreed window. If we need to reschedule due to weather, equipment issues, or other circumstances, we will contact you as early as possible to arrange an alternative date.
If you need to cancel or reschedule a confirmed appointment, please notify us at least 24 hours in advance. Cancellations with less than 24 hours notice for jobs where materials have already been ordered or prepared may be subject to a restocking or preparation fee, which will be disclosed at the time of scheduling if applicable.
For spray foam insulation jobs, property occupants, including pets, must vacate the premises during application and for the re-occupancy period specified in writing by Columbia Insulationbefore the job begins. Failure to comply with re-occupancy requirements releases Columbia Insulation from any liability related to occupant exposure during the curing period.
5. Payment Terms
Payment terms are specified in the written proposal for each job. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, a deposit may be required before work begins, the amount of which will be stated in the proposal.
Accepted payment methods are specified in the proposal. Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance, unless a different payment schedule has been agreed upon in writing.
If payment is not received and the matter is referred to a collection agency or attorney, the customer is responsible for all reasonable collection costs and attorney fees in addition to the outstanding balance.
6. Customer Responsibilities
The customer is responsible for ensuring that the work area is reasonably accessible on the scheduled date, including removing stored items from attics, crawl spaces, or other areas where work is to be performed. If the work area is not accessible as expected and additional time or a return visit is required, additional charges may apply.
The customer is responsible for ensuring they have the legal authority to authorize the work at the property, including any required landlord or homeowners association approvals.
7. Permits and Code Compliance
Columbia Insulation will obtain required building permits from the City of Columbia or relevant jurisdiction for work that requires permitting under the applicable building code, unless the customer requests otherwise in writing. Permit fees are in addition to the project price and will be itemized in the proposal.
All work performed by Columbia Insulation is intended to meet or exceed applicable building code requirements in effect at the time of installation. Code compliance is based on the codes adopted in the jurisdiction where the work is performed. Columbia Insulationmakes no representation that work will meet future code requirements adopted after installation.
8. Warranty
Columbia Insulation warrants that all work will be performed in a workmanlike manner using materials appropriate for the application. If a defect in materials or workmanship is identified within one year of the completion date, Columbia Insulation will, at its option, repair or replace the affected work at no additional charge, provided the defect is not the result of damage caused by the customer, third parties, or conditions outside the scope of the original installation.
Material warranties, including manufacturer warranties on insulation products, are governed by the terms of the respective manufacturer. Columbia Insulation will provide manufacturer warranty documentation upon request.
Except as stated above, Columbia Insulation makes no other express or implied warranties, including warranties of fitness for a particular purpose or merchantability. Columbia Insulation does not warrant specific energy savings results, as actual performance depends on factors outside its control including occupant behavior, HVAC system condition, and overall building envelope characteristics.
9. Limitation of Liability
To the fullest extent permitted by law, Columbia Insulation's total liability for any claim arising from the services provided or the use of this website is limited to the amount paid by the customer for the specific work giving rise to the claim.
Columbia Insulation is not liable for any indirect, incidental, special, or consequential damages, including loss of use, loss of revenue, or property damage not directly caused by our negligence.
10. Dispute Resolution
If a dispute arises between you and Columbia Insulation in connection with our services or these terms, the parties agree to first attempt to resolve the matter informally by contacting Columbia Insulation in writing at estimates@columbiainsulation.com. We will respond within 10 business days.
If informal resolution is not reached, disputes will be resolved by binding arbitration in Boone County, Missouri, under the rules of the American Arbitration Association, unless both parties agree in writing to a different forum. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 10 shall be brought exclusively in the state or federal courts located in Boone County, Missouri.
12. Modifications to These Terms
Columbia Insulation reserves the right to modify these Terms and Conditions at any time. Updated terms take effect upon posting to this page with a revised effective date. Continued use of this website or engagement of our services after changes are posted constitutes acceptance of the updated terms. It is your responsibility to review these terms periodically.
